So, you found an act of noncompliance. But was it intentional, or just an accident? In some cases, whether the act was intentional may not matter. But in many cases, intent makes a big difference. And proving that someone’s act of noncompliance was intentional is not always easy.

For example, when someone steals funds, intent is often easy to prove. Accumulating a million dollars of extra funds is hard to explain as being an accident. But when someone is violating a complicated law in a manner that benefits the organization, or themselves individually, it’s not always so clear. Indeed, “I didn’t intend to break the rule” is a common explanation.
