Summary of Less Commonly Used FLSA Exemptions

In addition to broad and more commonly applied categories of positions that are exempt from the overtime payment requirement of the Fair Labor Standards Act (FLSA), such as the executive exemption, there are other less common and more narrowly applied exemptions that are described in the chart below. You should consult with legal counsel to ensure these exemptions are properly applied in your organization and to ensure there aren’t additional state laws that might also apply.
