Noncompliance can be costly

This year offers compliance professionals the opportunity to learn from the past year’s Office for Civil Rights (OCR) settlements. As of November 30, Right of Access complaints against 12 providers had been settled in 2021.[1]

OCR opened the HIPAA Right of Access Initiative in 2019, and the first enforcement action occurred on September 9, 2019, against Bayfront Health, located in St. Petersburg, Florida.[2] Bayfront Health paid a $85,000 fine and entered a corrective action plan with the OCR. The complaint involved failure over more than nine months to provide timely medical record access to a mother regarding her unborn child.
