Do mandated compliance programs really contribute to increased compliance, more ethical conduct, and better corporate cultures, or do they send the wrong message, result in box-ticking, and possibly backfire in the form of malicious compliance? Is it better to use an incentive-based system, with enforcers having discretion in granting credit for strong, credible programs?
